Facts & Allegations:
Plaintiff's filed a wrongful death complaint on 5/6/04 alleging that decendent, Steven Baur, died of mesothelioma as a result of his occupational exposure to asbestos in the United States Navy (1971-1973) and as a boiler maker employed by Gundlach Champion, Inc. (1976-1977) and Riley Stoker (1977-1978).    Foster Wheeler denied Plaintiff's allegations and was dismissed by Plaintiffs immediately before their opening statement.
